CIFAS complaint - summary and our responses

This is part of the email complaint we received from CIFAS.

The main areas of concern on your website are:

• The categorisations could be made clearer (see the information below supplied by Credit Reference Agencies with copies of consumer files)

• There is no 'problem with CIFAS'.

• Consumers can see the data recorded on the CIFAS system. Consumers have a right to a copy of their credit file under the Consumer Credit Act's provisions, now incorporated into the Data Protection Act 1998 for a statutory fee of £2 as opposed to a subject access request where a fee of £10 is the norm.

• The CIFAS office does not hold data on consumers to which there is a right of subject access under the Data Protection legislation. The main CIFAS database is held by the UK's Credit Reference Agencies. Serving a subject access request on the CIFAS office is therefore a waste of money, time and effort. Obtaining a copy of the credit file from the Credit reference Agency is the sensible recommendation. The CIFAS Office is registered under the Data Protection Act as we do hold data on computers about our staff, payroll information and so on.

• There is no link between Registry Trust and CIFAS. We are separate organisations but in the same office block. (CIFAS made this complaint in a later email)
